Terms and Conditions of Use (T&C) - PetitBoulot.ch

ARTICLE 1. NATURE OF THE SERVICE AND ABSENCE OF MANDATE

PetitBoulot.ch is a technological matchmaking platform.
* Ad Platform: The Editor provides only the infrastructure for publishing and consulting advertisements. The Editor is not a recruiter, employment agency, employer, or labor leaser.
* Independence: The use of the site does not create any relationship of subordination, simple partnership, mandate, or brokerage between the Editor and the user.
* Contract Conclusion: Contracts (employment, mandate, sales) are concluded exclusively between users. The Editor is not a party to these contracts and assumes no obligation of guarantee or result regarding work quality or payment.

ARTICLE 2. ADMISSION CONDITIONS AND ACCOUNTS

  • Capacity: Users must be at least 16 years old (or have parental consent for light work permitted by Swiss law) and have full legal capacity.
  • Account Security: The user is solely responsible for the confidentiality of their login credentials. Any action taken from their account is deemed to have been performed by them.

ARTICLE 3. TOTAL EXCLUSION OF LIABILITY

To the maximum extent permitted by Swiss law (Art. 100 CO), the Editor disclaims all liability for:
* Damages: Any direct or indirect damage (material, physical, or financial) occurring during a connection or the execution of a service found via the site.
* Verification: The Editor does not verify the identity of members, the accuracy of ads, or the solvency/morality of users.
* Insurance: It is the exclusive responsibility of users to ensure they have adequate insurance coverage (Third-party liability, accident insurance, etc.).

ARTICLE 4. CONTENT AND COPYRIGHT LIABILITY

The Editor does not exercise prior control over content (texts, images, logos) uploaded by users.
* Third-party Rights: The user guarantees they hold all rights (intellectual property, image rights) necessary for the publication of their ad.
* Copyright Exclusion: The Editor disclaims all liability for any infringement of intellectual property rights by a user.
* Indemnification: The user agrees to indemnify the Editor against any third-party claims (legal fees, damages) related to the content they published.

ARTICLE 5. LEGAL, SOCIAL, AND TAX OBLIGATIONS

The user acknowledges they are solely responsible for complying with the Swiss legal framework:
* Social Security: Declaration to social security funds (AHV/IV/EO/ALV) and payment of mandatory social contributions.
* Taxation: Declaration of income to the relevant tax authorities.
* Labor Law: Compliance with laws regarding undeclared work ("travail au noir") and verification of work permits for foreign nationals.
PetitBoulot.ch shall not be held liable for any social or tax fraud committed by a user.

ARTICLE 6. MODERATION AND REPORTING

  • Reporting: Any illegal or suspicious content, or content violating copyright, must be reported exclusively via the dedicated contact form on the site.
  • Discretionary Power: The Editor reserves the right to delete an ad or an account without notice or justification.

ARTICLE 7. APPLICABLE LAW AND JURISDICTION

All legal relationships arising from the use of the site are subject exclusively to Swiss law. The exclusive place of jurisdiction is the Editor's place of residence.
